Terms and Conditions of Sale

These Terms and Conditions of Sale (T&Cs) govern all bookings made on the Dakhlagon website. Placing an order implies full acceptance of these T&Cs.

The French version of these Terms and Conditions is the authoritative version. This translation is provided for information purposes only. In the event of any discrepancy, the French version shall prevail.

1. Object and Scope

These T&Cs govern the contractual relationship between Dakhlagon (the 'Operator') and any adult individual (the 'Customer') wishing to book a service via the website dakhlagon.com (the 'Website').

The Operator acts as an intermediary and booking agent on behalf of local service providers based in Dakhla, Morocco (the 'Local Partners'). The service is performed by these Local Partners, not directly by the Operator.

These T&Cs apply to the exclusion of any other document and may be updated at any time. The applicable version is that in force at the date of the order.

2. Services Offered

The Website offers online booking of the following services in the Dakhla region (Morocco): private day excursions, private transfers (airport, hotel, city centre), leisure activities (kitesurfing, quad, camel ride, horse ride), and combined tours.

Service descriptions are indicative and may be modified due to weather conditions, Local Partner availability, site conditions or local regulations.

Photographs illustrating the services are not contractually binding. They aim to faithfully represent the environments visited.

3. Prices

Prices are quoted in euros (€) inclusive of all applicable taxes. Prices include: the service itself, private transport to and from your accommodation in Dakhla, and Local Partner accompaniment.

Prices do not include: travel insurance, personal on-site expenses, or tips (entirely at the Customer's discretion).

The Operator reserves the right to modify prices at any time. The applicable price is that displayed on the Website at the time the Customer validates their order.

4. Booking Process

Bookings are made as follows: (1) The Customer selects the desired service(s) and completes the online booking form. (2) The Customer proceeds to online payment via PayPal. (3) A payment confirmation email is automatically sent to the Customer. (4) The Operator confirms the booking by email within 24 hours, including the Local Partner's contact details.

The contract is concluded upon receipt by the Customer of the Operator's confirmation email. All bookings are personal and non-transferable.

5. Payment

Payment is made exclusively online, by credit/debit card or PayPal account, via the secure PayPal platform (paypal.com). The Operator has no access to the Customer's banking data. The transaction is processed and secured directly by PayPal in accordance with its own terms and conditions available at www.paypal.com.

Full payment of the service amount is required online at the time of booking. No deposit is accepted.

No payment is requested from the Local Partner on the day of the service. Any request for additional on-site payment should be reported to the Operator immediately as an anomaly.

6. Right of Withdrawal

Pursuant to Article L221-28(6) of the French Consumer Code, the 14-day right of withdrawal does not apply to contracts for leisure services to be provided on a specific date or period.

Therefore, any confirmed and paid booking for a specific date is firm and final. The cancellation policy set out in Article 7 applies.

7. Cancellation and Modification

Customer cancellations must be sent by email to dakhlagon@pm.me. Refund conditions: cancellation more than 72h before the service — full refund; cancellation between 24h and 72h — 50% refund; cancellation less than 24h before or no-show — no refund.

Operator cancellations: in case of cancellation by the Operator due to circumstances beyond its control, the Customer will receive a full refund within 14 days or may opt to reschedule.

Date changes are subject to availability and must be requested by email at least 48 hours before the service. No penalty applies if made within this timeframe.

8. Operator Liability

The Operator is a booking intermediary. Its liability is limited to the proper handling of booking formalities and the effective connection of the Customer with the Local Partner.

The Operator shall not be liable for: failure by the Local Partner to perform the service; adverse weather conditions; government decisions or local regulations; accidents or personal/material damages occurring during the service.

The Operator strongly recommends that the Customer take out travel insurance covering cancellation, repatriation assistance and civil liability before departure.

9. Force Majeure

Neither party shall be liable for failure to perform its contractual obligations if such failure results from a force majeure event as defined by French law (Article 1218 of the Civil Code), including natural disasters, epidemics, armed conflicts, government travel restrictions or border closures.

If a force majeure event lasts more than 30 days, either party may terminate the contract without penalty and the Customer will receive a full refund.

10. Mediation and Dispute Resolution

In accordance with French consumer law, the Customer has the right to use free consumer mediation to resolve a dispute amicably. The mediator designated by the Operator is: [NAME AND CONTACT DETAILS — to be completed].

If no amicable resolution is reached within 60 days, the dispute may be referred to the competent courts.

11. Applicable Law and Jurisdiction

These T&Cs are governed by French law. In the event of a dispute, the parties shall first seek an amicable resolution before any legal proceedings.

In the absence of amicable resolution, French courts shall have exclusive jurisdiction, subject to mandatory consumer protection rules applicable in the Customer's country of residence.
